The general idea behind this is to charge email marketers postage on each email sent out. The bill died pretty quickly but now we have yet another bill called the Can/Spam Act just enacted. With this for an email marketer it would mean exorbitant rates just to have the privilege of reaching their recipients. Who is behind this? The answer should be obvious; it is big corporations like Microsoft and AOL. I believe Microsoft is charging approximately a $1400.00 licensing fee to email marketers if they wish to be able to deliver their advertisements with MSN or Hotmail email addresses.

If that is not bad enough check out the latest with Identity Theft issues. It seems as though because of the problem being so huge, Credit card companies are now offering Identity Theft protection, yes you can get insurance now incase your identity is stolen, which of course you must pay for. Lets look at this concept for a minute, if you dont want to lose a bundle getting hit by an ID thief and you cannot be guaranteed your information will stay private, though the Privacy Act demands it, you must pay for protection.

When you sign up for an account with a Credit Card company and have to give them your personal information, they are supposed to protect that information from leaking out to those who could use it against you. What is even worse is when it really does happen, it involves so many innocent people not just one, that law enforcement officers tend to misunderstand what is really going on and tend to re-victimize innocent victims. In some recent cases Victims have actually been accused of crimes themselves and had to defend themselves against judicial systems that are failing to recognize the problem for what it is. They are falsely accused and jailed in some cases for crimes they did not commit, all because a thief took it upon himself to wreak havoc on one persons life.

The character in Mel Gibsons Conspiracy Theory would have a field day with this information. So herein lies the proof that every situation has potential to be turned into opportunity given the right attention be paid, and the drive take the steps to make it happen.

The above excerpt of § 101 is the basis of patent law in the U.S. With the exception of a small modification in 1952, § 101 has remained virtually unchanged since written by Thomas Jefferson. Until recent times, the statute gathered little attention. However, with the addition of software and business method patents in the 1980’s, the statute has been the subject of dispute. Until about 1981, the U.S. Patent Office held that steps performed by a computer were unpatentable under at least § 101. However, in Diamond v. Diehr, 450 U.S. 175 (1981), the Supreme Court overruled the Patent Office and held that, though an algorithm and the like are abstract and unpatentable, the fact that an otherwise patentable process is carried out on a computer does not make it unpatentable.

As a result, to this day, software and business method patents are often written in a roundabout manner. For example, Einstein could not patent his famous E=MC2 formula because this is considered an abstract law of nature. However, claim a method of determining the mass of an object based on measurements of light passing through the object, and you have probably at least overcome § 101.

If the difference between the first and second example seem fuzzy, it is because it is. A patent is nothing less than the creation of a property right from an intangible concept, and it is no easy task to define the boundary of an intangible right. King Solomon said, “. . . that which has been done is that which will be done. So there is nothing new under the sun” (Ecclesiastes 1:9). Yet, the Supreme Court famously ruled, “anything new under the sun made by man” is patentable. Diamond v. Chakrabarty, 447 U.S. 303, 309 (1980), quoting S.Rep.No 1979, 82d Cong., 2d Sess., 5 (1952).

For the past 30 years, the Patent Office and the courts have defined and redefined the difference between a patentable process and an abstract concept. No test has ever stood the test of time. A colleague of mine filed a patent we both knew the Patent Office was likely to reject under § 101. He retorted, “Who knows what the law will be in three years when the Patent Office finally examines this application?”

One of the presently used tests was stated by the Court of Appeals for the Federal Circuit in State Street Bank & Trust Co. Here, it was found that an idea is patentable if it produces a useful, concrete and tangible result. State Street Bank & Trust Co. v. Signature Financial Group, 149 F.3d 1368 (Fed. Cir. Jul. 23, 1998). However in 2006 Justices Scalia, Thomas, and Alito noted, “this Court has never made such a statement and, if taken literally, the statement would cover instances where this Court has held the contrary. ” Lab Corp. v. Metabolite, 548 U.S. ___ (2006) (referring to O’Reilly v. Morse, 15 How. 62 (1854) for Morse code).

Meanwhile, while the U.S. Patent Office’s Interim Guidelines for Examination of Patent Applications for Patent Subject Matter Eligibility (2005) generally follow the Federal Circuit, the U.S. Patent Office Appeals Board in Bilski distinguished State Street, as only applying to “machine implemented” processes (contradicting State Street itself). The decision, complete with an excerpt from Disney’s Pirates of the Caribbean, is nothing less than a demand that the Federal Circuit’s test be overturned, perhaps, in a bid to decrease that Patent Office’s seven-year backlog for business method patent applications. The Supreme Court may agree.

The Bilski opinion is in the process of being heard en banc at the Federal Circuit, but the issue over whether to draw the line between a man-made discovery versus an abstract concept will likely remain a controversy for a long time to come.

1) Walt formed his first animation company in Kansas City in 1921. He made a deal with a distribution company in New York, in which he would ship them his cartoons and get paid six months down the road. Flushed with success, he began to experiment with new storytelling techniques, his costs went up and then the distributor went bankrupt. He was forced to dissolve his company and at one point could not pay his rent and was surviving by eating dog food.

2) Walt created a mildly successful cartoon character in 1926 called Oswald the Rabbit. When he tried to negotiate with his distributor, Universal Studios, for better rates for each cartoon, he was informed that Universal had obtained ownership of the Oswald character and they had hired Disney’s artists out from under him.

3) When Walt tried to get MGM studios to distribute Mickey Mouse in 1927 he was told that the idea would never work– a giant mouse on the screen would terrify women.

4) The Three Little Pigs was rejected by distributors in 1933 because it only had four characters, it was felt at that time that cartoons should have as many figures on the screen as possible. It later became very successful and played at one theater so long that the poster outside featured the pigs with long white beards.

5) Snow White and the Seven Dwarfs was sneak previewed to College Students in 1937 who left halfway during the film causing Disney great despair. It turned out the students had to leave early because of dorm curfew.

6) Pinocchio in 1940 became extra expensive because Walt shut down the production to make the puppet more sympathetic than the lying juvenile delinquent as presented in the original Carlo Collodi story. He also resurrected a minor character, an unnamed cricket who tried to tell Pinocchio the difference between right and wrong until the puppet killed him with the mallet. Excited by the development of Jiminy Cricket plus the revamped, misguided rather than rotten Pinocchio, Walt poured extra money into the film’s special effects and it ended up losing a million dollars in it’s first release.

7) For the premiere of Pinocchio Walt hired 11 midgets, dressed them up like the little puppet and put them on top of Radio City Music Hall in New York with a full day’s supply of food and wine. The idea was they would wave hello to the little children entering into the theater. By the middle of the hot afternoon, there were 11 drunken naked midgets running around the top of the marquee, screaming obscenities at the crowd below. The most embarrassed people were the police who had to climb up ladders and take the little fellows off in pillowcases.

8) Walt never lived to see Fantasia become a success. 1940 audiences were put off by it’s lack of a story. Also the final scene, The Night On Bald Mountain sequence with the devil damning the souls of the dead, was considered unfit for children.

9) In 1942, Walt was in attendance for the premiere of Bambi. In the dramatic scene where Bambi’s mother died, Bambi was shown wandering through the meadow shouting,” Mother! Where are you, Mother?” A teenage girl seated in the balcony shouted out, ” Here I am Bambi!” The audience broke into laughter except for the red-faced Walt who concluded correctly that war-time was not the best time to release a film about the love-life of a deer.

10) The sentimental Pollyanna in 1960 made Walt cry at the studio screening but failed at the box office. Walt concluded that the title was off-putting for young boys.

Walt was human, he suffered through many fits of anger and depression through his many trials. Yet he learned from each setback, and continued to take even bigger risks which combined with the wisdom that experiencing failure can provide, led to fabulous financial rewards.

It is right on the lake and offers great camping facilities, comfortable cottages as well as an open air restaurant\bar.

They also rent four person tents with bedding for Kshs 850 per person (including camping fees) and there are even shared cooking facilities for self-caterers. If the odd bat doesn’t bother you the wooden hammer kop cottage with it massive deck, large loft and airy ambiance is the most atmospheric place for a snooze.

Campers need to exercise some common sense about the hippos’ which may graze within just a meter of your tent at night. Ideally you should stay at least 20metres away from them if you can especially if they have young ones and don’t frighten them with headlights, torches (flashlights), loud noises or flash photography. No one has been seriously injured by a hippo in almost 15 years but some readers have had decidedly close calls! Remember that they are wild animals and should be treated with respect.

(Kampi ya Samaki, lunch\dinner buffets Kshs 1300\1460, mains Kshs 300-700) as you would hope for this price the food is mostly excellent. While you may shed a tear paying Kshs 120 for a large tusker, one sip of it on the shady terrace or lakeside lawn and you will soon be laughing again.

Bahari lodge and Hotel

(Meals kshs 150- 200) Of Kampi ya Samaki’s few remaining local restaurants, this is the best place for cheap stodge.

Self caterers should keep in mind that while some foodstuffs may be available at Roberts’ camp, fresh vegetables and fruits are generally in short supply, and there is only a very limited stock available in Kampi ya Samaki. Bring much of what you need- Marigat usually has a good selection

Calatrava is the lead architect and engineer behind the Chicago Spire, which is set to be the tallest building in the U.S., to be located at 420 East North Water Street and 400 North Lake Shore Drive. Calatrava is a superstar among architects. That means living in a building like the Chicago Spire carries with it a great deal of prestige. After all, this is the man who designed the Milwaukee Art Museum.

The Chicago Spire is an environment-altering structure, an attraction in its own right. Never mind that people will pay good money to live there-people will come from miles around, perhaps even from other countries, simply to see it. After all, how many buildings have you ever seen that twists like a giant unicorn’s horn? How many buildings can be called the “hottest project in Chicago”?

The Chicago Spire has been the hottest project in Chicago since the plans were first unveiled. At that time, eight hundred people contacted developers to ask about reserving condos for themselves. June 2007 is when groundbreaking should begin. The building is set to be finished in 2010.

It is an interesting fact that Shelbourne Development Group, Inc., has been busy making sure that this building will not have an adverse effect on traffic patterns. The Chicago Spire represents a lot of new people moving into, through and around the neighborhood, with cars. But Shelbourne thought of that right from the beginning. Their plan is to use Lower Lake Shore Drive to feed traffic to the building, to keep traffic flowing smoothly. They have taken a holistic approach to the project.

Even bird rescue groups like the Chicago Spire. They like it because it is tall and thin, instead of wide and squat. A thin shape, they say, has less of an impact on migration. Originally, two wide towers were slated to be built in that spot. This one, the bird rescue groups say, is much better.

Speaking of a holistic approach, the Chicago Spire developers really have thought of everything. They know that a building’s surroundings are at least as important as the building itself, and so they are developing a nearby abandoned lot as well, turning it into a park for walkers and cyclers and joggers and other types of park-goers. But they haven’t stopped at that. There are also plans for a circular plaza and five-story glass atrium.

The actual units in the Chicago Spire are going to be spacious homes for people who like to live in luxurious style. You will have plenty of space to host gatherings or to raise growing families. After all, you will be living in the world’s largest condo highrise. You should have plenty of space. There was less living space in the original version of the Chicago Spire, but this version, which provides 3 million square feet of livable space, is a vast improvement, especially since it includes seven stories of underground parking and a bridge from the building to a nearby bike path. There will also be plenty of elevators to get you home.

A major attraction for art lovers, Salar Jung Museum was put together by Mir Yousuf Ali Khan (Salar Jung III), the Prime Minister of Nizam Osman Ali Khan. One of the largest private collections in the world that covers exhibits from every part of the world, the museum has over 35,000 items comprising of wood carvings, sculptures, Persian miniature paintings, weaponry and a library of 50000 books.

Birla Mandir
As the name indicates, Birla Trust in 1976 constructed the temple. Built with white Rajastani marble, the temple is located on Kalabahad, one of the twin rocky hills overlooking the south end of Hussain Sagar. The temple is dedicated to Lord Venkateshwara. The sanctum sanctorum of the temple is a replica of Venkateshwara temple at Tirupati.

Qutub Shahi Tombs
The royal cemetery of the Qutub Shahi kings lies about 2km from the Golconda Fort. The tombs are a scattered group of large domes and terraces. Perhaps this is the only place in the world where one can see so many tombs in one place. All the Qutub Shahi kings except Abdul Hassan Tana Shah who died in captivity in Daulatabad are buried here. These graceful domed tombs are surrounded by landscaped gardens.

Every year the largest Ganesh Idol is installed at Khairatbad in Hyderabad that is taller than thirty feet. On the 11th day of celebration, processions converge at Hussain Sager Lake. The ten-day Ganesh festival concludes with the immersion of Ganesh idols in the lake.

And then you do explode.

Usually when you explode, someone gets hurt. Some of your stress is relieved, and you might possibly even have felt good for a few moments while you were releasing, but it doesn’t last. The person or people you hurt may be the ones you love the most in the world–either way you don’t like the results of your explosion. You swore you wouldn’t do it again, but you just can’t seem to stop. You feel guilty, and you may or may not be able to apologize. When you do apologize nobody really believes you anymore. You might even think you were justified in your explosion, blaming someone else for how you felt.

Your needs still are not met. The problem is worse. But you got the temporary relief from anger/rage release, so if something doesn’t happen to break the cycle you will probably do it all again. This is addiction. You don’t have to live like this.

CYCLE BREAKERS

Fortunately, there are many different ways to break the cycle of anger/rage addiction.

1. Learn to meet your unmet needs. There is a sad, frightened child in every anger/rage addict, whether they know it or not. Once you begin to meet some of your own emotional needs, you will be more easily satisfied with what others can give you, taking a lot of stress out of relationships.

2. Identify the old behavior patterns and faulty thought processes that you have been using that maintain your addiction and destructive behavior. You may need Anger Management Counseling or an Anger Management Program to help you with that.

3. Giving yourself some relief from physiological distress can also help to break anger/rage addiction cycles. Exercise, a healthy diet, relaxation or meditation can be very helpful in this area. Getting plenty of rest is also essential to alleviating physiological distress.

4. Finding healthy ways to release your anger and rage can be extremely helpful for breaking the addictive cycle. You can read Dr. DeFoore’s book or listen to his Anger Management Techniques to learn more about healthy anger and rage release.

5. Experiencing physical release and relief with healthy anger work can be a major breakthrough for some people suffering from anger/rage addiction. Feeling powerful, being loud and using physical aggression in safe, non-destructive ways lets you know that it’s okay to be strong and take charge of your situation. And no one has to get hurt in the process.

WHEN RAGE BECOMES ADDICTIVE

The powerful rush of adrenaline that often accompanies anger feels good. It actually gives a person greater physical strength temporarily while the adrenaline is being released. After the release of anger, there is often a sense of euphoria and general well-being. If there has been a significant physical exertion during the expression of anger, there may also be endorphins released into the bloodstream, creating an even greater feeling of pleasure. All of this adds up to one point: you can get addicted to explosive releases of anger and rage.

It feels bad to store up feelings. Sometimes you get tense, irritable and uneasy. You may even develop physical pain from the tension, and possibly develop stress-related illnesses. The relief from tension experienced during aggressive behavior actually creates good feelings on a physical level, although you may be in great pain emotionally. That’s the nature of addiction. When pleasant feelings become associated with unhealthy and destructive behavior, you get addicted to that behavior.

The addictive cycle helps to illustrate how the pattern of suppression and explosion develops. The cycle begins when your needs for love, nurturance, support and security go unmet in childhood. This includes experiences of neglect, abandonment, rejection and the many types of direct abuse. Part of being born as a vulnerable child in an imperfect world means having experiences that are painful and frightening. One of the ways we protect ourselves from more pain is through the use of anger.

If your parents were not educated about the healthy value of anger, they may have punished or rejected you when you displayed this emotion. Unfortunately, you continued to be hurt in various ways, and many of your needs continued to go unmet. This causes a buildup of anger and frustration, leading to a breaking point in a situation you feel is “safe” to release your anger. The problem is that you tend to feel the safest (and the most angry) in your home with those you love. This is also where you tend to find the “last straw” that sends you “over the edge.”

That’s when the explosion occurs, followed by the rush of power and energy. At this point in the cycle, you may be verbally, emotionally or physically abusive. This usually leads to an apology or an attempt to “make it up to” the person or persons you have hurt. Some people don’t do this part; they just retreat into tremendous shame and guilt and don’t say a word about what has happened. Some powerful denial and blocking can occur at this point if the person is incapable of processing what has actually happened.

When apology or compensation does occur, the victim(s) may or may not forgive the abuser. It really does not matter. If the shame goes unhealed, the forgiveness will not be accepted. What matters is whether or not the person in the addictive cycle takes responsibility in the present, and takes care of unfinished business from the past. If they do, they’ve broken the cycle. If not, they will repeat the cycle and there will be more pain and suffering for all concerned. Fortunately, there are many effective ways to break the addiction cycle, and therefore no one has to be a victim to their addiction.

WHAT YOU HAVE TO LOOK FORWARD TO

When you have effectively broken the anger and rage addiction cycle, your anger becomes healthy. Healthy anger is one of the most powerful resources you can have, and you can use it in positive ways to create the life of your dreams.
